Privacy Notice for Gridware Candidates

Thank you for your interest in joining our team! This Candidate Privacy Notice is intended to provide you with information on how Gridware Technologies Inc. (collectively, “Gridware”, “we,” or “us”) collects, uses, and safeguards your personal information when you consider career opportunities with Gridware, such as when you apply for a position with us.

This Candidate Privacy Notice applies to the personal information we collect when you apply for a position with Gridware or are considered for a role as a contingent worker. It covers how we collect, use, secure, and share your personal information, as well as your rights regarding this information.
This Candidate Privacy Notice does not apply to Gridware’s website visitors or users of our products and services; please refer to our general website Privacy Notice and Product Privacy Notice for information about those contexts.
- Information we collect
We collect personal information relevant to your application, including:
- Contact Information: We may collect your contact information, such as full name, home address, telephone or mobile number, email address or online identifier, and job site information (e.g., LinkedIn profile).
- Identification Information: We may collect government-issued identifiers (such as driver’s license or passport information), citizenship, residency, and work authorization status, where permitted by law.
- Employment and Education Details: We may collect information relating to your employment and education, including your cover letter, resume/CV, work experience or other relevant experience, educational background, and achievements. Where relevant, we may receive information from identity verification services, professional licensing and certification bodies, employment research firms, and educational and training institutions.
- Background Checks: We may conduct background checks if you accept a conditional offer, as permitted by law.
- References: We may ask for references from your previous employers or academic supervisors.
- Publicly Available Information: We may collect information you’ve made public, such as your public profile on career networking sites (e.g., information on your public LinkedIn profile), your public website, or your code repository site (e.g., on Github).
- Mandatory Assessments. We may collect information related to any assessment that is mandatory to assess your suitability for the role, such as phone screens, interviews and skills assessments (e.g., take-home work tests, coding assessments).
- Monitoring of Gridware Networks and Resources. If you visit a Gridware office or other facility , we may collect information relating to building access and on-premise monitoring for security purposes (e.g., video surveillance and building security systems used to protect our personnel, facilities and property). If you access and use Gridware devices, networks (e.g., corporate wifi), or other resources, we may collect information related to your access and use (e.g., domain names and IP addresses).
- Interview Notes and Recordings: We may take interview notes and, where permitted by law, conduct and retain recordings or transcripts of interviews.
- Online Usage Information: We may collect your online usage information when you browse our websites (such as our career page), including cookie information, traffic data or profiles.
- Sensitive Personal Information: In limited circumstances, we may collect information such as demographic information or background check information, as permitted by law. This may include information required for equal employment opportunity reporting, accommodations, work authorization verification, or similar legal requirements.
- Certain personal information is necessary for us to evaluate your candidacy, communicate with you, verify qualifications, or comply with legal obligations. If you choose not to provide requested information, we may be unable to consider your application or proceed with the recruiting process.
- Where we collect information from
We may collect such personal information about you from the following sources:
- Directly from you. We collect personal information directly from you, for example when you provide contact details or your résumé. You may also choose to voluntarily provide us with Sensitive Personal Data.
- From referrals. To the extent you are referred by someone else, we collect information from the individual who referred you.
- From references. We may receive references from your previous employers or others, including individuals whose contact information you share with us.
- From recruitment and staffing partners or other jobs websites. We collect information from recruitment and staffing partners or other jobs websites.
- From third party data providers. We may receive information such as your education, work experience, and contact information from third-party data providers who have the rights to provide us with your information. These providers collect your information from publicly available sources, or through third parties they work with.
- Professional bodies. We may receive information from professional licensing and certification bodies, employment research firms, identity verification services, and educational and training institutions.
- From publicly available sources. We may receive information from other publicly available sources, such as information that you have chosen to make public online (e.g., your public LinkedIn profile).
- Background check providers. Where permitted or required by law, we receive background check information from background check providers.
- Information we collect automatically. When you submit an application online (e.g., through our careers page), we, or our third-party service providers (such as third-party applicant tracking systems) may collect information sent to us by the device you use, such as your computer IP address, device identifiers, and how you arrived at our website.
- How We Use Candidate Data:
We use your personal information for:
- Contacting you about job opportunities.
- Reviewing applications, scheduling interviews, and assessing qualifications.
- Assessing your skills, qualifications, and interests against our open positions.
- Enhancing our recruitment processes and reporting.
- Meeting legal and contractual obligations, such as verifying work or educational history or eligibility to work in the country in which you applied for a job, conducting background checks, or submitting reports that may be required by local law.
- Protecting our interests, including protecting our legal rights and the security and integrity of our facilities, equipment, and electronic platforms.
We do not use your personal information for purposes that are materially different, unrelated, or incompatible with the purposes described above without providing additional notice where required by law.
We may use technology tools, including tools that assist with organizing, transcribing, evaluating, summarizing, or managing recruiting activities. We do not currently use automated decision-making technology to make employment decisions without appropriate human review. If we materially change our practices in the future, we will provide any notices required by applicable law.
Lawful Basis for Processing (UK/EU/Brazil Candidates)
When you apply for a job, we process your personal information with the intention of entering into a contract for employment or contractor services. If we decide not to proceed with your application, we may retain your personal information under our legitimate interest to contact you if another role becomes available or if the chosen candidate does not work out. Please let us know if you would prefer that we do not do this. We may also retain your personal information if we need to comply with a legal obligation (e.g., conducting a legally required background check).
If you have consented to our use of your personal information for a specific purpose, you have the right to withdraw your consent, but this may not affect any processing that has already taken place or that has been de-identified so that we can no longer identify you. Where we are using your personal information because we have a legitimate interest to do so, you have the right to object to that use.
Information Sharing
- Like most companies, we use a number of other companies as part of our data processing, for example recruiting platforms, applicant tracking systems, interview scheduling providers, background check providers, and cloud service providers.
- We disclose your personal information to third parties such as our background check provider and also when we are required to do so by law, if there is an emergency situation, or to protect Gridware’s interests.
- We may also disclose personal information in connection with a merger, acquisition, financing transaction, reorganization, bankruptcy proceeding, sale of company assets, or similar corporate transaction.
We do not sell or share your personal information (as those terms are defined under applicable law) and do not use it for cross-context behavioral advertising.
Cross-Border Transfers
Your personal information may be transferred to jurisdictions with different data protection standards, as necessary for the purposes outlined in this Privacy Notice. If you are a UK or EU candidate, please note that when you provide your personal information to us, you acknowledge that we are a U.S.-based company and that we only transfer your data outside of the UK or EU if:
- The country or organization is deemed by the UK or EU to provide adequate protection of data, including the UK/EU/US Data Privacy Framework;
- If the transfer is necessary for the pre-contractual measures with you, or the performance of the actual employment contract; or
- Other appropriate safeguards have been put in place, such as Standard Contractual Clauses and related measures, to the extent required by law, to help ensure your data is handled securely and in compliance with regulations.
Data Retention
Except as otherwise permitted or required by applicable law or regulation, we will retain your personal information as long as necessary to fulfill the purposes for which it was collected. This includes satisfying legal, accounting, or reporting obligations, and resolving disputes.
Data Security
We implement measures to protect your data from unauthorized access and misuse. However, no security measure can guarantee complete protection.
If Your Application is Successful: Should you continue your employment or assignment with Gridware, we will retain your information to manage your ongoing relationship with us, and a separate privacy notice will apply.
If Your Application is Unsuccessful, Withdrawn, or Declined: In the event your application is unsuccessful, you withdraw, or you decline an offer, we may retain your personal information for a length of time. In determining the length of time, we consider criteria such as whether we need the information to continue providing our Services, comply with legal obligations, and other factors set out in this section. This retention is for the purposes outlined in this Candidate Privacy Notice, such as considering you for future roles, evaluating our recruitment processes, and maintaining necessary records.
Your Data Rights
Depending on where you live, you may have several rights regarding your personal information, including the right to:
- Request information about the personal information we collect, use, disclose, or retain about you;
- Request access to personal information we maintain about you;
- Request correction of inaccurate personal information;
- Request deletion of personal information, subject to applicable exceptions;
- Request a copy of certain personal information you have provided to us;
- Opt out of certain types of processing where such rights are provided by law; and
- Not be discriminated against for exercising applicable privacy rights.

In some circumstances, applicable law may permit or require us to deny or limit a request, including where information must be retained to comply with legal obligations, establish or defend legal claims, complete the recruiting process, or for other lawful purposes.
Gridware does not sell personal information of candidates, share their personal information for cross-context behavioral advertising, or use sensitive personal information to infer characteristics about candidates.
Changes to This Candidate Privacy Notice
We may update this Candidate Privacy Notice periodically. The effective date of the latest version will be noted at the top of this Candidate Privacy Notice.
